I've done as Richie suggested & have logged a complaint with Trading Standards & this is most of their reply.
In reference to your query, it appears that you have a claim against DemonicArts for a breach of contract if the goods have not been delivered within the time stated on their website. You would be looking for the trader to either cancel your order and provide a full refund or give them a further deadline to send out the goods.
In addition, you have rights under the Consumer Protection (Distance Selling) Regulations 2000. These state that if goods are not received within 30 days of purchase (unless otherwise specified), a consumer can deem the contract to be cancelled and request for a full refund to be provided. The trader must provide a full refund within days of this cancellation in order to comply with these regulations.
I would recommend that you send a recorded delivery letter to DemonicArts, outlining the situation and mentioning the legislation as set out above. Make time of the essence (i.e. 7-10 working days) for either the goods to be delivered or a full refund to be provided. Ensure to keep a copy of the letter for your own records. I have also passed the details of your case to the relevant Trading Standards authorities for their information. You may wish to make the trader aware of this.
